Trying to pay my deceased mother's late condo fees. I have lived in this condo with her for over 20 years and stayed here after she passed because I was the person who paid most of the bills. The condo is legally in her name. The condo association referred the lake condo fees to their lawyer. I sent them a cashier's check for the lake condo fees following their directions. Now this debt collector / lawyer wants my mother to sign a paper giving them authorization to discuss her financial issues with the condo. This lawyer does not know my mother has passed and her to sign. I understand the lawyer is just trying to cover themselves legally and not disclose any of my mother's financial information without her permission. However I am worried that if I tell him that she has passed and that she cannot sign the paper and that I have been paying all her bills, that he will not accept the payment until I go to probate Court? Is that a possibility or do you think the lawyer will not be worried about discussing my mother's financial information with me if he knows she is passed? Also by not accepting this payment the lawyer is keeping the condo association from getting funds that they want and for which the lawyer has been hired to collect.
Yes, I agree, you need a probate attorney. He will inform the Condo Assoc and the lawyer that Mom has passed. For now, no information concerning her finances can be given out. Maybe say something to the effect the bills we continue being paid. Are you inheriting the condo? If so, maybe lawyer can say something to the effect that you have inherited the condo. Its now just a matter of settling the estate.
Are you approved to live in the condo by the HOA? If not, that could be another issue.
