My brother has a house he was paying her a personal loan on and has quit paying for the house. When we took her to Utah then California. is now residing with my sister in Washington she has become to much to handle for my sister and her Husband How can we get care from Medical and get her house back ? she is out of money sold her Main home and used the money for care already.

Her MediCal ended when she left California. First, sis and bro have to dig up five years of financial records. Then they apply for Medicaid where she lives now. You did not say where the brother lives, but if he quit paying, she has to foreclose the loan, or else Medicaid considers it a gift.

Wendy, I am sorry but your post was a bit complicated to follow. Correct me if I am wrong, your brother bought a house using a loan provided by your mother.... how long ago was the loan made and when did he stop paying? If it was within the past 5 years, Medicaid might consider the amount still owed and not being paid as a "gift". That amount would be deductible from any funds Medicaid would use for your mother.

Your mother sold her house, so there is no way of getting it back.

Or is there another house? If there is another house, Medicaid could put a lien on it, which will be sold to help pay for any nursing home care.

Please note that Medicare doesn't pay for nursing homes, nor put liens on houses. I know the two [Medicare and Medicaid] can be confusing since they sound alike.

Your Mother can move to any State in the union and apply for Medicaid, but each State has their own rules and regulations, thus your Mom would need to qualify.
