My father was in the hospital after a bad accident, it appears my aunt and the attorney may have had my father leave everything to his sisters not me his only daughter as the will has been 15 years.On the same day my father was diagnosed as completely incompetent by the physiatrist due to dementia. If after my attorney gets a copy of the will since we are filing for guardianship on both parents what can be done. Can my fathers sisters contest the will if it wasn't change and still all remaining items left to me. If they are foolish enough to challenge that will after they deserted my father and mother as DPOA what recourse to I have as to making the sisters pay the court cost for my portions if these things were to occur? Thank you

Fully contestable if he was declared incompetent the same day. Due to the conflict, the Judge will likely appoint an independent guardian to your father. You did not say if mom has dementia. If she is fully functional she will not need a guardian. Bear in mind the will leaving everything to you and nothing to her may also be thrown out.

Ps, dad was diagnosed with Dementia late 2012 and early 2013, mother in August of 2013. I had to get an other attorney to help sort this out due to the distance at this time. I hated having to get another attorney involved the cost is outrageous, but my name was cleared of any accusation's. It's been really horrible, had no idea the Killer Ants, mainly killer ant 1, were cable of this. I'm not surprised at my father's actions at all if it be the case. I won't know for sure everything until after the attorney get guardianship. I ask she take them over, the state was no help at all they just blew off everything I told them. No other agency reported to them my fathers insanity, the neighbors were to afraid to call the state, since my fathers go to place is to sue. Just the thought of contesting a will is distasteful to me the entire experience with my family has been distasteful.
