My Dad was in for short term rehab to get strength back from urinary retention and he had a foley catheter put in to help him void while in the Nursing home he had to be rushed to the ER unconscious from sepsis. The medical reports said he had a blocked catheter and a UTI that caused kidney failure he passed away 27 days later in the hospital my Dad was in otherwise good shape. Its even worse the one day we couldn't visit him due to bad weather we called him at 9 30am to check on him and he was slurring already we called nurse station and they said everything is fine don't worry 24 hours later hes being rushed to ER my question is are the nurses responsible for keeping catheter free from being blocked and what about the UTI that caused kidney failure?

Pam I'm not sure if you read the original post my Dad was taken from the NH and rushed to the ER unconscious with septic shock didn't open his eyes for 3 days and was urinating pure blood for a week how can the NH blame the hospital? We also put in a complaint with the NJDOH and told them everything on how my Dad was neglected but we haven't heard back from them yet...I have never heard of JCAHO but I will look into it thanks

The NH will point fingers at the hospital and the hospital will deny fault. I would have filed a complaint with the jointcommission.org instead of suing but to each his own. You see, they will be happy to settle and pay you, but the JCAHO can cancel their accreditation and hurt them much more.

Thanks everyone we have a lawyer who just does nursing home neglect we found out today from him we have a case wrongful death..It has been months in the making and he finally had the chance to go over the nursing home records in which he said were a joke how they were kept and the ER and hospital records...It is on record we told the nursing home staff something was wrong and they did nothing 24 hours later my Dad was wheeled out with septic shock...Staff isn't supposed to let a UTI turn septic where was the care? Anyway today was the day we got the good news that the people who neglected him will be held accountable?

The only way to really find out what happened you are going to need to see the charting by the nurses that was kept during this time period. You may need a lawyer for this. You need to see if they were checking his vital signs, what his mental status was like, what were the amouts of his intake and output.Also it is not so much what is charted but what IS NOT charted. They only way to know for sure you have got to get your hands on those records and this may take a lawyer. Who has the DPOA, if his wife is still alive and competent she would be legal next of kin and have to be the one to request the record. Would act soon as things can sometimes disappear.

I am so sorry that all this happened to your Dad. The nurses in a nursing home look after catheters in residents as best as they are able, but they are not able to keep them from being blocked. Nurses and caregivers cannot prevent UTI's from occurring, but maybe when the nurses said your Dad was fine, they could have had a look at him. Unfortunately, several things have happened to your father, and for elderly person, little things become big things. I hope this helps.
