Hi I was trying to transfer my dad’s truck in my name before he passed but the paperwork was not done correctly unfortunately before he passed. After he passed my mom went into care and I refilled at a massachusetts rmv having her sign an affidavit and the back of my dads title.

His vehicle is now a part of his estate.

This falls now to an executor of estate, if there is a will, or to whomever in the family will be appointed administrator of the estate is there is no will.
If this vehicle is held by husband and wife, and wife is living, it is now hers, and will be a part of her assets, tho one vehicle is exempt until death so will likely not count against her.

I have a hard time understanding fully how title on this is held and whether or not your mother, if she is now owner, is competent or not.
If there is any value at all in this truck I would contact an attorney for advice.

If there is medicaid recovery, then yes, the vehicle will likely be a part of that.

Did u inherit the truck? Is there something written by Dad that said the truck was to be yours. Did the Will read "whats mine is yours" meaning Mom inherited everything?

Is Mom paying privately at this point? On Medicaid or filing for it? If she is already on Medicaid, was the car included in her assets? If not, don't worry about it now. If filing, I may just not include it in her assets. I say this because, some times trying to do the right thing causes a lot of problems. If car was in Dads name only, I would not worry about it. If in Moms name or Mom and Dads name, I may worry about it.

When I filed for Moms Medicaid, I was not aware of shares she had until I started seeing a dividend ck of $50 a quarter. When I researched, she had $5000 in shares from an insurance policy my deceased Dad had. If I had cashed them in, 5k would not have even paid 1/2 of her NH monthly fee. And what I had to go thru to cash it in, was not worth it. So I let them sit. When she passed and I was settling her estate, which was just her house, I looked at the 5k again and asked my brothers if I should cash in or leave them there, they said to put it in my name. Which I did with no problem. No, I do not feel guilty. When we sold Moms house, Medicaid received their money.

So have you received a letter from State LTC Medicaid program that there is a transfer of assets concern on your mother’s application?
or
are you worried about this as you read or have been told by others this will be a huge issue for her eligibility?

Should the title transfer be an issue, the actual value of the truck will - in my experience - be central as to just what mom or you as her POA can do about this and perhaps have it become a nonissue.
