Your sister would have to be conscious and mentally competent to assign anyone a POA. Did she have any end of life directives, DNR? Talk to a social worker at the hospital. They can be very helpful.

She is not and may never be again..she has a husband and he is going to turn it over to me..She had nothing she is 46 and I guess your never ready in life for this kind of thing to happen. I think by Law in Michigan he has the right to turn her over..I'm her sister 10 years older then her and have been the only one taking care of her and by her side sense March 4th when this all started..And no DNR..

I'm afraid it will be much more complicated than you imagine. I think you and your BIL had better consult a lawyer, he will need one for the divorce anyway, and her interests will need to be looked after in any divorce settlement. I'm sorry this has happened to your family.

I would contact an attorney immediately. Trying to figure out what you need and if it meets legal standards on your own is so risky. It's normally not too expensive and can really help if it's done properly. Her being married carries issues that you need to be aware of. Get legal advice is crucial.
